Premises Liability: What Pool Owners Are Responsible For

Premises liability law in Pennsylvania says that property owners – and that includes hotels, community centers, waterparks, gyms, and even private clubs – have a legal duty to keep their facilities reasonably safe for guests. That responsibility is especially important during the summer months, when pools become high-traffic areas and the risk of injury goes up.


So what does “reasonably safe” actually mean when it comes to pool areas? It includes:

  • Proper supervision and lifeguard staffing - If a facility offers swimming access, it should also have trained professionals on duty – especially if children are present. A lack of lifeguards or unqualified staff can be considered negligence if someone gets hurt.
  • Working safety equipment - Life rings, rescue hooks, AEDs, and first aid kits should be easily accessible and in working condition. A malfunctioning piece of lifesaving equipment can quickly turn an emergency into a tragedy.
  • Clean, well-maintained grounds and pool areas - Slippery tiles, broken ladders, loose drain covers, and cloudy water can all pose serious hazards. Property owners are expected to perform regular maintenance and fix issues promptly.
  • Clear rules and signage - Safety instructions, depth markers, and “No Diving” or “Swim at Your Own Risk” signs aren’t just helpful – they’re required. If signage is missing or unclear, it could be a violation of premises liability standards.


If a pool owner fails to uphold any of these responsibilities and someone is injured as a result, they can be held legally and financially accountable. You shouldn’t have to pay the price for someone else’s negligence.
