What to Do if Your Employer Wants You Back Before You’re Ready

Attorney Nicole F. Bednarek • March 31, 2026

After a workplace injury, many employees feel pressure to return before they are medically ready. Sometimes the request is friendly. Other times it feels urgent or uncomfortable. Either way, it is important to understand your rights before stepping back onto the job.

Why Employers Push for Early Returns

Employers may want to limit costs, fill staffing gaps, or believe light duty will speed recovery. While these goals may seem reasonable, your health must come first.

Returning too soon can worsen your injury, delay healing, and put your workers’ comp benefits at risk.

What the Law Says

Your return to work should be guided by your treating doctor, not workplace pressure. If your physician has not cleared you, you generally should not return. Light duty must fall within the medical restrictions provided.

You have the right to ask questions and to request clarification in writing.

Steps to Protect Yourself

If your employer is pushing you back:

  • review your medical restrictions carefully
  • communicate in writing when possible
  • keep copies of all work requests and responses
  • speak with a workers’ comp attorney before agreeing

At Slusser Law Firm, we help injured workers understand when returning makes sense and when it puts their recovery at risk. If you are unsure who to trust, that uncertainty is a sign to slow down and seek guidance. Contact us today!
